Please read these terms and conditions as they contian important information about the Online Learning Program.

  1. The following information is copyright. Ownership of, and copyright in, any, manuals documents, images, video, know how, forms provided by Motivate You Disability Fitness Services always remain the property of Motivate You Disability Fitness Services.
  2. Copying, reproduction and/or distribution (in any form) of any course material are strictly prohibited unless written permission is granted by Motivate You Disability Fitness Services.
  3. Re-selling, re-packaging or amending any course content, including presenting the content in face to face workshops; or courses, or in any other form is prohibited.
  4. Motivate You Disability Fitness Services will seek recompense for any breaches of copyright through all avenues provided by the legal system.
  5. The information within the educational modules is not a substitute for medical advice, or for gaining medical advice from suitably qualified medical professionals. Motivate You Disability Fitness Services strongly advises that a medical clearance is required for people with disabilities prior to commencing a fitness program.
  6. The information contained in the educational modules has been sourced from 2015 and 2016 studies and university research. Motivate You Disability Fitness Services  is not responsible; nor liable for any claim, losses, damages or injuries resulting from amendments or new findings in research.
  7. The information contained in the courses or modules contain examinations. Only persons undertaking the examination will deemed competent in supporting a fitness program and will be issued with a certificate.
  8. The educational modules are designed to educate and inform carers, staff and people working with people with disabilities to support disability fitness programs.
  9. The information presented in the modules does not qualify a person to design, develop, implement and review fitness programs.
  10. Only suitably qualified, insured and registered by a professional body, fitness professionals can/should;
    1. Liaise with medical and allied health professionals.
    2. Screen clients for medical conditions.
    3. Design, develop, implement and review fitness programs.
  11. The customer agrees warrants and acknowledges that they will not design, develop, implement nor review fitness programs unless they are suitably qualified and the conditions set out in clause 10 are met.
  12. Motivate You Disability Fitness Services is not liable in respect to any injury, harm or damage caused or arising from unqualified, unregistered persons undertaking fitness professional tasks and duties.
  13. Motivate You Disability Fitness Services is not liable in respect to any injury, harm or damage caused or arising from information contained in the educational modules.
  14. Motivate You Disability Fitness Services is not liable in respect to any injury, harm or damage caused or arising from information including but not limited to, exercises, assessments, programs or recommendations provided by 3rd parties mentioned, referenced, or contained within the modules.
  15. The customer hereby waives, releases and forever discharges Motivate You Disability Fitness Services (including its employees, agents and contractors) from any claims, liabilities and any responsibilities or for any losses, damages, injuries resulting from, or incidental to the services or educational modules.
  16. Motivate You Disability Fitness Services is not responsible for end-user errors, technical or computer issues, internet connections or any other technological issues or incompatibilities.
  17. Motivate You Disability Fitness Services will take reasonable care but Motivate You’s maximum liability for any loss, damage, injury or failure to deliver any Services, or any part of the services, is strictly limited  to supplying any part of the services again.
  18. Purchases of the Online Modules are Non-Refundable.
  19. In the event of any issues or difficulties relating to content or completing the exam, the end-user is required to ontact Motivate You Disability Fitness Services. Motivate You Disability Services will endeavour to provide support the end-user.
  20. In the event that Motivate You Disability Fitness Services cannot complete any part of the services due to an act of God, severe weather conditions, riots, civil disturbances, action by any government department or public authority or any event  outside the reasonable control of Motivate You. Motivate You’s maximum liability, if any, is strictly limited to a refund to the customer of monies (or part thereof) actually paid by the customer to Motivate You Disability Fitness Services.
  21. The customer acknowledges this agreement, the material, and all information relating to or incidental to this agreement supplied to or obtained by the customer are confidential.
  22. The customer acknowledges they have read, understood and agree with all details, terms and conditions of this agreement.
